U.S. Department of Labor OSHA Vaccine Rule Withdrawn

This week, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) withdrew the vaccination and testing emergency temporary standard (ETS) that was issued on November 5, 2021, requiring private employers with 100 or more employers to require vaccinations, or testing of employees. Earlier this month, the Supreme Court held a special session to hear arguments on the ETS and ruled that OSHA did not have the authority to issue such a broad vaccine rule. OSHA has withdrawn the vaccine rule; however, OSHA may revise the rule and reissue a rule that is more permanent.
